Justice Delayed but not Denied
Khondkar A Saleque
Thursday, 11.19.2009, 09:44pm (GMT)

The self confessed killers of the founding father of Bangladesh Bangabandhu Sheikh Mujibur Rahman will now get the due punishment. Bangladesh Supreme court in a historic verdict. has upheld the death sentence judgement of high court of 12 killers. Barring Presidents clemency there is no way these obnoxious weeds will be hanged till death for the heinous crime after 34 years of the incident. Bangabandhu Sheikh Mujibar Rahman after years of relentless struggle emancipated Bangladesh from the oppression and repression of Pakistani rulers. The nation fought glorious liberation war in 1971 and earned liberation on 16th December 1971 at the cost of supreme sacrifice of 3 million and pains of thousands of our tortured women. The peace loving world community deplored genocide in Bangladesh.

Bangabnadhu arrested on the night of Army Crack Down- Operation Search light was given death sentence in Pakistan Zail but had to be released after Bangladesh independence. He returned in war ravaged Bangladesh and started another war to rebuilt Bangladesh from ruins. Defeated force from very first day started conspiracy. Some powerful government were supporting defeated forces (Pakistan Army and their cohorts) during the war. These evil forces continued conspiracy. Bangabandhu in a very short time restored economy with limited resource presented the constitution of 1972, made Indian Army leave Bangladesh, bring back stranded Bangladeshi. But the evil force continued sabotaging and undermining government efforts. The worldwide famine situation in 1974 and natural calamities created food shortage. US government made ship loaded with wheat return without delivering the food. Some planted agents of Pakistan Army Intelligence in Bangladesh liberation force under tacit support of ambitious senior army officers killed Bangabandhu along with most of the family members of his family on the fateful night of August 15th 1975. This very group on November 4th killed 4 top liberation war leaders in custody in the central Jail.

The army ruler backed puppet government of Khondkar Mushtaque Ahmed passed Indemnity bill protecting the self confessed killers. Later Army Ruler rewarded the killers with prized diplomatic posting. Army ruler also formed political party exploiting his official facilities and later established the war criminals and anti liberation forces in independent Bangladesh.

The politics of killing continued. Hundreds of freedom fighter army officers including several liberation front sector commanders were killed for different reasons. Unfortunately the army ruler also got killed by army officers.

These all happened while Bangabandhu killers, war criminals remained at large and got firmly rooted in Bangladesh. Organised sponsored terrorism killed several more innocent lives. Bangladesh became safe heaven of terrorist...

In 1996 the party which led liberation war came to power and through another amendment scrapped indemnity bill and started the trail of Bangabandhu killers .Some of the killers got arrested. High court awarded death sentence. But the trial could not be completed before the new Government of BNP- Jamat took over. In 7 years from 2002 – 2009 the trail did not progress. Rule of Law could not be established.

Now highest court of Bangladesh has established the verdict of High Court. The killers can now seek Clemency of the head of the state. If not guaranteed the killers can be executed within 45 days.

There is a saying that Justice Delayed is Justice denied. But it is a rare case that Justice delayed but not denied.12 Killers will be hanged and few others will serve life term. 5 killers are in jail others are on the run. Hopefully they will be netted soon.

This verdict will go a long way in establishing the Rule of Law in Bangladesh and will serve strong warning to all killers.
